Respecting Privacy and property rights of station locations and observers

Respect private property rights at all times. This extends beyond private residences to include businesses, and it may also include government facilities. If you do not get permission to go onto private property, you must respect this right and do not trespass.
When asking permission to survey a site, be completely honest of your identity and intent. Do not misrepresent who you are or what you are doing. State specifically why you are visiting the site.
Clearly state that pictures of their site, any diagrams of their site, and the survey form will be on a publicly accessible website.
Ask them if they wish to have their approval of any pictures, diagrams or survey form which will be posted on the website.
Do not include any information in the pictures or survey form which will identify the exact location of any private site (including
business) without the owner's permission. For example, it would be OK to say the site is located along a busy road about one mile north of town. Do not include, without the owner's permission, an exact location or the contact name for the site (such as the owner of the property is Roger Smith and the site is at 345 Highway 275 in Smalltown, CO).
Do not take any pictures of sites at private residences or attempt to do a survey from a public location without the owner's permission. If you cannot reach the residents of a house or if they refuse permission for you to enter their property to survey the site, do not take pictures or do a partial survey from a public place or another location. For example, if a site is at a house and the owner does not wish you enter their yard to do a survey, do not even attempt to take pictures from the public road or a neighbor's property (even if this is "legal").
Always be courteous and respectful on your visit.
Being an observer is a commitment. Do not do anything which will lessen the morale of the COOP observer program. Where would the program be without the dedicated observers?
Do not under any circumstances, ignore no trespassing signs or other restrictions to entry.
If the location of the weather station is at a public airport, do not under any circumstances, attempt to enter of photograph the property without permission of the airport administrator.
Stations and information about them that is at a open and publicly accessible place, such as at a public entity like a police, fire, or ranger station, or where the station is visible from the street or sidewalk by any member of the public passing by (such as the station being in front of the building next to the sidewalk) would be considered to be in the public domain. However, whenever possible, notify someone who may be in charge of the station or facility of your intent if at all possible.

Content

Content submitted must be original works from your own camera.
No retouched or enhanced photos will be allowed. Photos that appear to be retouched will be deleted.
Photos may be annotated with text, lines, circles, or arrows to point out detail, but no other modifications are acceptable
All images sent to the surfacestations.org website are subject to the Terms of Use, License, and User Conduct listed below.
By contributing to surfacestations.org website you agree to grant us the rights set out in the Terms of Use. Essentially, these mean that you agree to grant surfacestations.org a royalty-free, non-exclusive and sublicensable permission to publish and otherwise use the material in any way that we want, and in any media. That means we can reproduce your image however and wherever we want, but it also means that you can as well. You will still own the copyright to everything you contribute. These rights come into effect upon sending the image.
We reserve the right not to publish or to remove images that are submitted and to edit the comments that accompany the image. The website editor's decision is final.
We reserve the right to deal with the images within the time frame that the surfacestations.org website editors see fit.
Where used by surfacestations.org website, we agree to credit your image to you in the photo display page.

BY UPLOADING, POSTING, SENDING OR SUBMITTING PHOTOGRAPHS, PICTURES, IMAGES OR ANY OTHER CONTENT INCLUDING WITHOUT LIMITATION, GRAPHICS, VIDEO, DATA, TEXT, FILES, LINKS, SOFTWARE, MUSIC, SOUND, ("CONTENT") TO surfacestations.org YOU ARE CONSENTING TO BE BOUND BY THESE surfacestations.org PHOTO SUBMISSION TERMS OF USE AND BY THE APPLICABLE PROVISIONS OF THE surfacestations.org TERMS OF SERVICE INCLUDING BUT NOT LIMITED TO THE surfacestations.org END-USER LICENSE AGREEMENT, PRIVACY POLICY AND USAGE NOTICES AND ANY OTHER DOCUMENTS AVAILABLE ON OR THROUGH http://www.surfacestations.org/rules.htm (COLLECTIVELY AND SEPARATELY REFERRED TO AS THE "surfacestations.org TERMS OF SERVICE") . License

You hereby grant surfacestations.org, Inc., its affiliates, subsidiaries, assignees, licensees, and legal representatives ("surfacestations.org") the irrevocable, perpetual, worldwide license to use, reproduce, edit, market, store, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote the Content (as such may be edited and modified by surfacestations.org in its discretion) through the surfacestations.org Web site, surfacestations.org Software and such other products or services as surfacestations.org may designate in any medium now known or hereafter devised, for editorial, commercial, promotional and all other purposes.

While you retain ownership of all right, title, and interest in the Content itself, you agree that surfacestations.org owns all right, title, and interest in any compilation, collective work or other derivative work created by surfacestations.org using or incorporating the Content. You further understand, and thereby authorize, that your photograph and any other Content may be accessed, viewed, stored or reproduced by surfacestations.org and viewed by any of surfacestations.org's members or other visitors to the surfacestations.org Web site. You waive any right to privacy. You waive any right to inspect or approve uses of the photograph or Content or to be compensated for any such uses.

User Conduct

You agree that you will not upload, post, submit or send any Content to surfacestations.org in order to distribute, facilitate distribution, or directly link to any content that: (1)is offensive, vulgar, sexually explicit, racial, hateful, discriminating, unlawful, invasive of another's privacy, exploitation of a minor, identifiable information of a minor, information or instructions concerning illegal activities, information that is harmful, violent, threatening, abusive, harassing, defamatory, libelous, tortuous, obscene, or otherwise objectionable; (2) harasses, threatens, abuses, defames, degrades, embarrasses or causes distress or discomfort upon another; (3) solicits for exchange, sale or purchase of sexually explicit images, and/or material harmful to minors; including, but not limited to, any photograph, film, video, or picture or computer generated image or picture (actual or simulated). (4) you don't have a right to transmit under any law, including but not limited to Content that infringes patent, trademark, trade secret, copyright or other proprietary right or violates any right of privacy or publicity; (5) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (6) disrupts the normal flow of information available on or through surfacestations.org Web site or the surfacestations.org Service or otherwise, interferes with or disrupts the functionality of surfacestations.org Web site , surfacestations.org Service, servers or networks, directories, databases and listings; (7) is unsolicited advertising, promotional materials, or any other forms of solicitation; (8) intentionally or unintentionally violates any applicable local, state, national or international law or regulation; (9) impersonates in any way any person, entity, leader, surfacestations.org official, operator or host; (10) collects or stores personal data about other users in any way or form or solicit or harvest passwords or screen names; (11 ) links to or refers to content not allowed under these surfacestations.org Photo Submission Terms of Use; (12) otherwise uses the service in a manner deemed inappropriate by surfacestations.org.

By submitting to surfacestations.org, you hereby represent that you are at least 18 years of age and that you have read these surfacestations.org Photo Submission Rules, Terms of Use, License, and User Conduct and are fully familiar with its content and agree to be bound by its provision.
